Service Details and Public Interest:
The Central Information Commission (CIC) has clarified that service details of a public servant are generally not considered confidential and can be provided to an RTI applicant.
Section 8(1)(j) of the RTI Act:
This section exempts personal information from disclosure, but it also states that such information can be disclosed if it relates to a public activity or interest, or if the larger public interest justifies it.
Case-by-Case Basis:
Whether or not service register information is disclosed depends on the specific details of the request and the public interest involved.
Examples:
In some cases, the CIC has allowed the disclosure of information about duty rosters and leave details (excluding the reasons for leave) as they relate to public activity.
In other cases, information about complaints against a public official and subsequent actions taken by authorities has been deemed disclosable.
However, information about individual employees' personal details (like date of joining, promotions, etc.) may be considered exempt under Section 8(1)(j) if it's deemed to be a private matter.
Decisions by CIC:
The CIC has made decisions on this topic, sometimes allowing disclosure of certain service record details and other times upholding the exemption under Section 8(1)(j)}.
Online RTI Portal:
You can file an RTI application online through the RTI Online Portal rtionline.gov.in.
